1. Acceptance of Terms

By creating an account or using any part of the Qualixir platform, you agree to be bound by these Terms of Service. If you do not agree, do not create an account or use the service. These terms constitute a legally binding agreement between you and Arzaan Consulting ("we", "us", "the Company"), operating in Calgary, Alberta, Canada.

2. Service Description

Qualixir is an AI-powered test automation platform. We offer the following products:

• Qualixir F1 — AI-driven UI testing with browser automation, vision analysis, and automated test reporting.
• Qualixir T1 — API and integration testing with AI-generated test cases and validation.
• Qualixir Complete — A bundled offering combining F1 and T1 capabilities.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials and any API keys associated with your account.
• Providing accurate and up-to-date information during registration.
• All activity that occurs under your account, including actions taken by team members you invite to your organisation.
• Notifying us immediately at support@qualixir.ai if you suspect unauthorized access to your account.

4. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble any part of the Qualixir platform.
• Scrape, crawl, or use automated tools to extract data from the platform beyond its intended APIs.
• Attempt to gain unauthorized access to systems, accounts, or data not belonging to you.
• Use the platform to test targets you do not own or have explicit authorization to test.
• Use the service for any illegal purpose or in violation of applicable laws.
• Resell, sublicense, or redistribute access to the platform without our written consent.

5. Intellectual Property

The Qualixir platform, including all software, algorithms, designs, documentation, and branding, is the exclusive property of Arzaan Consulting and is protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform during your active subscription period.

Your data — including uploaded documents, test cases, screenshots, reports, and any content you create within the platform — remains your property at all times.

6. Data Handling

We take your data seriously. Test data, screenshots, generated reports, and training documents you upload or create belong to you. We do not sell, share, or monetize your data. Upon account closure, your data remains available for export for 30 days, after which it is permanently deleted. For full details, see our Privacy Policy.

7. Payment Terms

Paid subscriptions are billed on a recurring monthly basis via Stripe. By subscribing, you authorize us to charge your payment method on file each billing cycle. Prices are as follows (subject to change with 30 days written notice):

• Starter: $79/month
• Professional: $249/month
• Enterprise: $599+/month (custom pricing available)

8. Service Availability

We strive to maintain 99.5% uptime for the Qualixir platform on a best-effort basis. Starter and Professional plans do not include a formal Service Level Agreement (SLA). Enterprise customers may negotiate a custom SLA with guaranteed uptime and support response times. Scheduled maintenance windows will be communicated via email with at least 24 hours notice.

9. AI Disclaimer

Qualixir uses artificial intelligence (powered by Anthropic Claude) to generate test results, step verdicts, reports, and training documents. These AI-generated outputs are advisory in nature and should not be treated as deterministic or infallible. Human review is required before making production decisions based on AI-generated results. We do not guarantee the accuracy, completeness, or reliability of AI outputs.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Arzaan Consulting shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with your use of the platform.

Our total aggregate liability for any claims arising under these terms shall not exceed the total fees you have paid to us in the 12 months immediately preceding the event giving rise to the claim.

11. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the Billing page in the app or by emailing support@qualixir.ai. We may terminate or suspend your account if you violate these terms, with notice where practicable.

Upon termination, your data will remain available for export for 30 days, after which it will be permanently deleted from our systems.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

13. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
